Guardrails for AI in staffing and recruiting

Hiring is one of the most regulated uses of AI. These are the rules the systems are designed around, and your employment counsel confirms how they apply to you.

EEOC, Title VII, the ADA and the ADEA

Federal anti-discrimination laws enforced by the EEOC apply when AI tools help screen or rank candidates, and employers and agencies can be responsible for a vendor tool's discriminatory effect. Systems here explain matches with job-related evidence, exclude protected traits and obvious proxies, support accommodation requests, and leave every screening decision to a recruiter. Selection outcomes are monitored for adverse impact.

NYC Local Law 144 and state AI hiring laws

New York City's Local Law 144 requires an annual independent bias audit, a published summary and candidate notice before an automated employment decision tool is used for NYC roles. Illinois regulates AI analysis of video interviews and, under an amendment to its Human Rights Act, AI use in employment decisions. Colorado has passed its own AI law. Tools are scoped so recruiters decide, and any tool that would qualify gets an audit plan first.

FCRA and background checks

The Fair Credit Reporting Act requires a standalone disclosure and written authorization before a background check, plus pre-adverse and adverse action notices before acting on a report. Many cities and states also have fair chance or ban-the-box laws. The system tracks each step and deadline, and staff make every decision based on a report.

TCPA, CAN-SPAM and candidate data privacy

Texting candidates with an automated platform generally requires consent under the TCPA, and opt-outs must be honored.
