IRS Circular 230 and practitioner responsibility
Circular 230 governs practice before the IRS, including due diligence, competence and the standards for written advice. AI can draft research outlines, workpapers and notice responses, but the CPA, EA or attorney reviews the work and owns every position and signature.
FTC Safeguards Rule and IRS security requirements
Tax and accounting firms are covered by the FTC Safeguards Rule under the Gramm-Leach-Bliley Act, which requires a written information security program, and the IRS expects preparers to keep a written data security plan.
